# Terms and Conditions
Effective Datese Terms and Conditions govern the use of coastlisting.ca** and all photography, videography, drone, floor plan, virtual tour, editing, and related real estate media services provided by CoastListing (“CoastListing,” “we,” “us,” or “our”).
By using our website, booking a service, approving a quotation, providing access to a property, downloading deliverables, or otherwise using our services, you (“Client,” “you,” or “your”) agree to these Terms and Conditions.
## 1. Services
CoastListing provides real estate media services, which may include:
* Interior and exterior photography
* Real estate video and walkthrough reels
* Drone photography and video
* Measured 2D floor plans
* 360-degree virtual tours
* Twilight photography or virtual twilight editing
* Social media content
* Image and video editing
* Other media services agreed to in writing
The exact services, deliverables, pricing, and schedule for each booking will be stated in the applicable package, quotation, invoice, booking confirmation, or written agreement.
## 2. Prices and Quotations
All prices are stated in Canadian dollars unless otherwise indicated.
Prices shown on our website are starting prices and may vary depending on property size, location, travel requirements, requested deliverables, access conditions, preparation requirements, rush delivery, additional editing, or other project-specific factors.
Applicable taxes and approved additional charges may be added to the final invoice.
A quotation may be changed if the information provided by the Client was incomplete or inaccurate, or if the requested scope changes before or during the appointment.
## 3. Booking and Client Authority
A booking is confirmed when CoastListing accepts the requested date and provides confirmation to the Client.
The Client confirms that they have permission from the property owner, tenant, occupant, listing representative, strata, or any other necessary party to:
* Enter the property;
* Photograph and record the property;
* Operate equipment at the property;
* Create floor plans or virtual tours; and
* Use the completed media for the purposes requested.
The Client is responsible for obtaining all required permissions before the appointment.
## 4. Property Access
The Client must provide safe and timely access to the property at the scheduled appointment time.
Lockbox codes, entry instructions, parking instructions, alarm information, tenant arrangements, and other access details must be provided before the appointment.
If access is unavailable, delayed, unsafe, or restricted, CoastListing may shorten, reschedule, or cancel the appointment. Additional travel or rescheduling charges may apply and will be considered based on the circumstances.
CoastListing is not responsible for delays caused by unavailable access, incorrect instructions, locked rooms, occupants, pets, contractors, showings, or other activities taking place at the property.
## 5. Property Preparation
The Client is responsible for ensuring the property is clean, organized, safe, and ready to be photographed before the scheduled appointment.
Unless specifically agreed otherwise, CoastListing is not responsible for cleaning, staging, moving furniture, making beds, removing personal belongings, organizing rooms, landscaping, or performing repairs.
Our team may make minor adjustments when reasonably possible, such as opening blinds or moving a small item. We are not required to move heavy, fragile, valuable, hazardous, or personal items.
The property will generally be photographed in the condition in which it is found. Additional editing, object removal, virtual staging, or a return visit may result in additional charges.
## 6. Safety and Right to Refuse Service
CoastListing may refuse, pause, or stop work where conditions are unsafe, unlawful, threatening, unsanitary, or likely to damage equipment or property.
This may include aggressive animals, unsafe structures, hazardous materials, illegal activity, severe weather, unsafe occupants, active construction, or other conditions that create a reasonable safety concern.
Any rescheduling or charges resulting from unsafe conditions will be determined based on the circumstances.
## 7. Cancellations and Rescheduling
Cancellation and rescheduling requests are handled case-by-case.
The Client should provide as much notice as reasonably possible. When determining whether a fee applies, CoastListing may consider:
* How much notice was provided;
* Whether travel had already started;
* Time reserved for the appointment;
* Work already completed;
* Weather conditions;
* Property access issues;
* Emergency circumstances; and
* Non-refundable third-party expenses.
Depending on the circumstances, CoastListing may waive a cancellation fee, reschedule the appointment, charge a reasonable cancellation or travel fee, or invoice the Client for work and expenses already incurred.
Repeated last-minute cancellations or missed appointments may require advance payment for future bookings.
## 8. Weather, Drone and Outdoor Services
Outdoor photography, drone services, twilight photography, and similar services depend on weather, visibility, property conditions, airspace restrictions, safety requirements, equipment availability, and applicable laws.
CoastListing has the final decision regarding whether drone operations or outdoor services can be performed safely and legally.
When weather or operating conditions are unsuitable, CoastListing may:
* Complete the indoor portion of the appointment;
* Reschedule the affected service;
* Use suitable existing footage where authorized;
* Provide an alternative service; or
* Remove the unavailable service from the final invoice.
CoastListing is not responsible for delays or unavailable drone coverage caused by weather, airspace restrictions, nearby airports, emergency activity, regulatory requirements, property conditions, or other matters outside our reasonable control.
## 9. Delivery Times
Most standard bookings are targeted for next-morning or next-day delivery. Larger projects, premium video editing, virtual tours, extensive revisions, floor plans, rush periods, technical issues, or other special requests may require additional time.
Delivery dates and times are estimates unless CoastListing expressly guarantees a deadline in writing.
A delay caused by circumstances outside our reasonable control does not automatically entitle the Client to a refund.
## 10. Delivery and File Storage
Deliverables may be provided through an online gallery, download link, cloud platform, email, client portal, or another delivery method selected by CoastListing.
The Client is responsible for downloading and securely storing all delivered files. CoastListing does not guarantee that online galleries, virtual tours, links, or archived files will remain available indefinitely.
The Client should promptly report any missing, damaged, or inaccessible files.
## 11. Revisions and Corrections
The Client should review the deliverables and report any technical error, missing agreed deliverable, or reasonable correction request within seven calendar days after delivery.
CoastListing will determine whether a requested correction is:
* Included within the original scope;
* A minor technical correction;
* A stylistic preference;
* Additional editing;
* A new creative direction; or
* Work caused by changes to the property after the appointment.
Reasonable corrections involving an error by CoastListing will be addressed without additional charge.
Additional editing, object removal, virtual staging, major revisions, changes in creative direction, or work not included in the original booking may be charged separately.
## 12. Re-Shoots
A re-shoot may be offered when a significant technical issue caused by CoastListing prevents the agreed deliverables from being reasonably used.
Re-shoots requested because the property was not ready, access was restricted, lights were not working, construction was incomplete, landscaping changed, furniture was moved, the weather changed, or the Client later preferred a different presentation may be treated as a new appointment and charged accordingly.
CoastListing may choose, as appropriate, to correct the work, provide a re-shoot, issue a service credit, or refund the affected portion of the service.
## 13. Floor Plans and Measurements
Floor plans, measurements, square footage calculations, room dimensions, and property layouts are provided for marketing and informational purposes only.
Although reasonable care is taken, measurements may be approximate and can be affected by wall thickness, inaccessible areas, equipment limitations, property shape, measurement methods, or human error.
Floor plans and measurements must not be relied upon for construction, renovation, appraisal, legal boundaries, financing, insurance, permits, engineering, architectural work, or other professional purposes.
The Client, property owner, buyer, seller, and their representatives should independently verify all measurements and property information when accuracy is important.
## 14. Accuracy of Property Information
The Client is responsible for confirming the accuracy of all addresses, prices, features, room descriptions, property details, branding, names, logos, contact information, and text supplied to CoastListing.
CoastListing is not responsible for inaccurate information supplied by the Client or obtained from third-party listing sources.
## 15. Payment
Payment is due after final delivery of the agreed services.
Unless the invoice states a different payment date, payment is due upon receipt of the final invoice.
A revision request does not delay payment for services already completed and delivered unless CoastListing agrees otherwise in writing.
CoastListing may suspend future bookings, additional revisions, hosting services, virtual tours, gallery access, or the Client’s licence to use the deliverables while an invoice remains overdue.
The Client is responsible for reasonable costs incurred by CoastListing in collecting a valid overdue account, to the extent permitted by law.
## 16. Refunds
Because CoastListing provides customized creative services, completed services and delivered media are generally non-refundable except where required by law or expressly approved by CoastListing.
Concerns will normally be addressed through a correction, replacement file, re-edit, re-shoot, service credit, partial refund, or another reasonable solution determined according to the circumstances.
## 17. Ownership and Copyright
Unless otherwise agreed in a written copyright assignment, CoastListing retains all ownership and intellectual property rights in the photographs, video footage, edited videos, floor plans, graphics, virtual tours, and other media created by CoastListing.
Raw photographs, unedited footage, project files, editing timelines, templates, presets, source files, and unused content are not included unless expressly stated in writing.
The Client may not claim authorship of the deliverables, remove ownership information for the purpose of misrepresenting authorship, resell the deliverables as stock content, or register the deliverables as their own intellectual property.
## 18. Client Licence
After full payment, CoastListing grants the Client a non-exclusive licence to use the delivered media for:
* Marketing the photographed property;
* MLS and Realtor.ca listings;
* Brokerage and realtor websites;
* Social media;
* Digital and printed advertising;
* Email marketing;
* Listing presentations; and
* The Client’s professional portfolio.
This licence does not transfer copyright ownership.
Unless CoastListing agrees in writing, the Client may not sell, sublicense, transfer, or provide the media to another realtor, photographer, media company, builder, designer, staging company, publication, or unrelated third party for separate commercial use.
A new licence may be required when a listing changes agents or when a third party wishes to use the media for a separate business purpose.
## 19. Client-Provided Materials
The Client confirms that they have the right to provide and authorize the use of all logos, music, photographs, videos, trademarks, property details, testimonials, graphics, and other materials supplied to CoastListing.
The Client is responsible for claims resulting from materials or instructions supplied by the Client that infringe another party’s rights.
## 20. People Appearing in Media
The Client is responsible for obtaining permission from homeowners, tenants, occupants, models, agents, contractors, or other identifiable individuals who will appear in photographs or video.
CoastListing may decline to capture or publish identifiable people where appropriate consent has not been confirmed.
## 21. CoastListing Portfolio and Promotion
Unless the Client asks us in writing not to do so, CoastListing may use completed media for its portfolio, website, social media, advertisements, demonstrations, awards, and other promotional purposes.
CoastListing will take reasonable steps not to publish private access information, alarm details, lockbox codes, or other sensitive personal information.
A portfolio opt-out should be requested before the appointment or before final delivery.
## 22. Third-Party Platforms
Some services may rely on third-party platforms, including gallery providers, virtual tour platforms, cloud storage services, payment processors, map services, social networks, music licensing services, and MLS-related systems.
CoastListing is not responsible for third-party outages, platform changes, account restrictions, compression, altered image quality, removed content, lost links, or changes to third-party terms.
The Client is responsible for ensuring that their use of the deliverables complies with the rules of the platforms on which the media is published.
## 23. Website Use
The content on coastlisting.ca is provided for general information and service-booking purposes.
You may not:
* Attempt to damage, disable, copy, scrape, or interfere with the website;
* Upload malicious code;
* Use the website for unlawful or fraudulent purposes;
* Misrepresent your identity;
* Copy website content for commercial use without permission; or
* Attempt to gain unauthorized access to accounts, systems, or information.
Website availability, pricing, content, packages, and features may be changed or removed without notice.
## 24. Privacy
CoastListing may collect personal information reasonably required to:
* Respond to inquiries;
* Schedule appointments;
* access and photograph properties;
* Deliver services;
* Process invoices and payments;
* Provide customer support;
* Maintain business and tax records;
* Prevent fraud or misuse; and
* Comply with legal obligations.
Information may be processed by trusted service providers where reasonably necessary to operate the business.
CoastListing will handle personal information in accordance with applicable privacy laws and any separate Privacy Policy published on the website.
## 25. No Guarantee of Property Results
CoastListing provides professional media and marketing services but does not guarantee:
* A specific number of views, inquiries, showings, or offers;
* A particular sale price;
* The speed at which a property will sell;
* Social media engagement;
* MLS performance;
* Search engine rankings; or
* Any other real estate or marketing result.
Property performance depends on many factors outside CoastListing’s control.
## 26. Disclaimer of Warranties
Services and website content are provided on an “as available” basis.
CoastListing will perform its services with reasonable care and skill. However, to the fullest extent permitted by law, CoastListing does not provide warranties regarding uninterrupted website access, third-party platforms, exact colours across different screens, permanent file hosting, marketing results, or matters outside the agreed scope.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
## 27. Limitation of Liability
To the fullest extent permitted by law, CoastListing will not be liable for indirect, incidental, special, punitive, or consequential losses, including lost commissions, lost profits, lost listings, delayed publication, missed sales opportunities, loss of data, or reputational damage.
CoastListing’s total liability relating to a booking will not exceed the total amount paid or payable for the specific services giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
## 28. Client Responsibility and Indemnity
The Client agrees to be responsible for losses, claims, costs, or expenses arising from:
* The Client’s breach of these Terms;
* Unauthorized access to a property;
* Missing permissions or releases;
* Inaccurate information supplied by the Client;
* Unlawful or unauthorized use of deliverables;
* Client-provided materials that infringe third-party rights; or
* Unsafe conditions not disclosed before the appointment.
This section applies only to the extent permitted by law.
## 29. Events Outside Our Control
CoastListing is not responsible for delays or failure caused by events outside our reasonable control, including severe weather, wildfire, flooding, power or internet outages, illness, accident, road closures, equipment failure, platform outages, government restrictions, airspace restrictions, emergencies, labour disruptions, or other force majeure events.
We will make reasonable efforts to communicate with the Client and reschedule or provide an appropriate alternative.
## 30. Ending or Refusing Service
CoastListing may refuse or terminate a booking where:
* The Client breaches these Terms;
* An invoice remains unpaid;
* The requested work may be unlawful;
* Required access or permission is unavailable;
* The Client or another person behaves abusively or threateningly;
* Conditions are unsafe; or
* Continuing the work would reasonably expose CoastListing or another person to harm or liability.
The Client remains responsible for services and expenses incurred before termination.
## 31. Governing Law
These Terms and any dispute relating to the website or CoastListing’s services are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
The parties agree to first attempt to resolve disputes through good-faith communication. If a dispute cannot be resolved, it may be brought before a court of competent jurisdiction in British Columbia.
## 32. Changes to These Terms
CoastListing may update these Terms and Conditions periodically.
The updated version will be posted on coastlisting.ca with a revised effective date. The Terms in effect when a service is booked will generally apply to that booking unless the parties agree otherwise in writing.
## 33. General Terms
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A delay in enforcing a right does not waive that right.
These Terms, together with the applicable booking confirmation, quotation, package description, invoice, and any written project agreement, form the entire agreement relating to the services.
Electronic communications and approvals may be treated as written communications.
